By using this Flex Enrolment Web Site for Plan Members (the “Site”) you signify that you have read and understand these Terms of Use and agree to be bound by them. If you do not agree to these Terms of Use, you must exit this Site immediately.

Alberta Blue Cross may revise these Terms of Use at its sole discretion and at any time. Because you are bound by these revisions, you should review them each time you use this Site.

Alberta Blue Cross provides this Site for use by employees (Members) to electronically enroll themselves and their spouse/partner and dependents, if eligible, for benefits (the “Benefits”) under their Alberta Blue Cross group benefit plan (the “Plan”). Once the Member has submitted his/her benefit selections to Alberta Blue Cross, the file cannot be accessed except through a written request to the Member’s group plan administrator (the “Administrator”).

1. Alberta Blue Cross operates under privacy legislation including Alberta’s Health Information Act (HIA) (2001), the Personal Information Protection Act (PIPA) (2003), the Freedom of Information and Protection of Privacy Act (FOIPP), and the federal Personal Information Protection and Electronic Documents Act (PIPEDA) (2001), as it pertains to the collection, retention and use of personal Member information. Alberta Blue Cross will endeavor to ensure that all appropriate steps are taken to safeguard this information from unauthorized access.
2. The Member is responsible for maintaining the confidentiality of the Member’s password. Access to the Site and/or the personal information submitted through the Site by any party using the Member’s password will be deemed as authorized by and binding upon the Member.
3. Alberta Blue Cross has taken reasonable measures to protect the security of your personal information on this Site. This information is contained within secure databases protected by proven data security systems and processes, including 128-bit encryption.
4. Alberta Blue Cross shall take reasonable and appropriate precautions to ensure the Site does not contain computer viruses. However, the Member shall be solely responsible for monitoring and protecting the integrity of the Member’s own computer system when using the Site or downloading any data, text, images, files or other information from this Site.

1. Alberta Blue Cross makes every effort to ensure that current and accurate information is accessible through this Site. However, information may change before Alberta Blue Cross or the Administrator updates this Site to reflect such changes. Internet software or transmission problems may also produce inaccurate or incomplete copies of information downloaded or displayed on your computer.
2. The Member is solely responsible for the accuracy of any personal information the Member enters on this Site. The Member is advised to print and retain a copy of this information as a record of that entry.
3. Alberta Blue Cross provides this Site to facilitate the enrolment of you, the Member, and your eligible spouse and dependents for group benefits, according to the contract between Alberta Blue Cross and your employer who is responsible for providing Benefits to plan members. Information provided or collected through this Site does not in any way alter or affect the terms of that contract. The Member is advised to contact the Administrator for details pertaining to his/her coverage such as specific benefits, limitations and exclusions.
4. As the Member, I understand that personal information provided herein, as well as any other personal information currently held by Alberta Blue Cross about me and eligible dependents will be used to determine eligibility for benefits, verify, assess and pay claims, and administer my Plan. I certify that I am authorized by my spouse and/or other adult dependents to disclose and receive information about them that is used for these purposes. I hereby acknowledge and agree that the personal information may be exchanged between Alberta Blue Cross and a health care professional, practitioner, institution, health benefits provider or insurer, or third-party administrator approved by the employer, when needed for a purpose stated above. I understand that the personal information will be kept confidential and secure. I understand I may revoke this consent at any time and acknowledge that should I do so, my coverage may be denied or rescinded. I understand why the personal information is needed and am aware of the risks and benefits of consenting or refusing to consent to its use as described above. I have read and understood this consent and declaration.

1. The Administrator is responsible for the accuracy of the Member’s personal pre-loaded enrolment information appearing on this Site. If the Member identifies any missing or incorrect personal information, the Member must contact the Administrator who will make the necessary corrections.
2. The Administrator may modify any personal information entered by the Member. It is the Member’s responsibility to address any issues or concerns related to modified personal information directly with the Administrator.

1. This Site may, from time to time, contain links to other Alberta Blue Cross web sites so that users can conveniently access information and services of interest to them. Alberta Blue Cross makes every reasonable effort to ensure that information or services available through these web sites are accurate.
2. Members acknowledge that any third-party web sites accessible through this Site are maintained by persons or organizations over which Alberta Blue Cross exercises no control and Alberta Blue Cross expressly disclaims any responsibility for the content, accuracy, quality, and/or the Member’s downloading of products or services available through these third-party web sites.

1. This Site and its contents are provided “as is” and “as available.” Members will use this Site at their own risk. Alberta Blue Cross, to the fullest extent permitted by law, disclaims all warranties of every kind, whether express or implied, statutory or otherwise. Alberta Blue Cross explicitly disclaims any representation, warranty or condition of merchantability, fitness for particular uninterrupted or error-free services, or inter-operability of products and services, whether arising by usage or trade, course of dealing, course of performance, statute, or otherwise.
2. Alberta Blue Cross will not be responsible for or liable to the Member for any loss or damage the Member, or any other party claiming through the Member, may suffer in connection with the use or misuse of this Site, the inaccuracy of data supplied by the Administrator or the Member, or the use of email to communicate electronically between the Member and Alberta Blue Cross. This limitation applies regardless of the form of action, whether based on warranty, contract, tort or other legal theory.
3. All rights of ownership associated with the Site are retained entirely by Alberta Blue Cross and will not be transferred, assigned, loaned, leased, rented, licensed, sold, distributed or otherwise disposed of in any way whatsoever without the prior written consent of Alberta Blue Cross. Except as permitted herein, the Administrator will not modify, reformulate, disassemble, reverse engineer or decrypt any of the Site contents.
4. Any use of the Site not expressly permitted by these terms of use is a breach of these Terms of Use and will violate copyright, trademark or other laws. All rights not expressly granted herein are reserved.
5. All proprietary Alberta Blue Cross information on the Site is protected by copyright laws and cannot be sold, published, distributed or used by the users of this Site for their own commercial or other purposes.
6. The Blue Cross symbol and name are registered trademarks of the Canadian Association of Blue Cross Plans, used under license by ABC Benefits Corporation, an independent licensee of the Canadian Association of Blue Cross Plans, doing business under the trade name Alberta Blue Cross. The Site may contain other registered and unregistered trademarks, trade names and service marks belonging to, or used under license by, Alberta Blue Cross. The appearance of such marks and names does not convey any rights to the Member to use them without the prior written consent of Alberta Blue Cross.
7. Alberta Blue Cross reserves the right to disable the Site as required for routine maintenance or other technical servicing purposes. In the case of an unanticipated Site failure, Alberta Blue Cross will make its best attempts to restore the Site to normal operating conditions as quickly as possible. Temporary disruption of the Site will not constitute a breach or termination of this Agreement.
8. The Member agrees to indemnify Alberta Blue Cross for any losses, costs, charges, damage, and expenses, including legal fees and disbursements on a solicitor and his own client basis, arising from the Member’s breach of the Site’s terms of use, or any negligence, default, or unlawful acts of the Member that are associated with the misuse or unauthorized use of the Site.

1. If any provision of these Terms of Use is deemed invalid by a court of competent jurisdiction, all other provisions will remain in force.
2. Should Alberta Blue Cross waive any provision herein, such waiver will not constitute the waiver of any other provision.
3. This Site, its content, and these Terms of Use will be governed by the laws of Alberta and Canadian laws applicable therein, and the courts of Alberta will have exclusive jurisdiction.
